Recalled equipment: what South Dakota requires

South Dakota does not require a recall check

We read South Dakota’s licensing rules in full. They contain no requirement for licensed providers to monitor or document product recalls. We are telling you this even though it means you have less reason to pay us, because a page that invents a rule to sell a subscription is worth nothing to you and would deserve nothing from you.

What the rules do say

The strongest negative we found: we pulled the entire Article 67:42 (all eighteen chapters) and South Dakota’s rules never mention the CPSC at all. Important distinction — the state’s own provider HANDBOOK says providers “may wish to check on a regular basis” that toys have not been recalled. That is hortatory guidance, not a rule, and presenting it as a requirement would be false. Several chapters are repealed; everything now lives in 67:42:17.

Recalled children’s gear is still dangerous, and a recalled crib in your care is still a liability whether or not a form asks about it. The free screening below works regardless.

ARSD ch. 67:42:17 (Child Care Licensing), effective 3 July 2023
