Recalled equipment: what Vermont requires

The requirement

The program director shall ensure that toys and other equipment used by children are sturdy and free from hazards such as but not limited to rough edges, pinch and crush points, splinters, exposed bolts, small loose pieces, areas that cause entrapment, and free from recall from the U.S. Consumer Product Safety Commission.

What kind of duty this is

A standing prohibition. Your state says you may not have recalled items on the premises. It does not require you to run a check on a schedule, and there is no state form.

Your state prescribes no recall form. Anything we generate for you is a convenience record for your own files — it is not a state form, and we will not pretend otherwise.

Worth knowing

Vermont’s regulations are not codified in a numbered administrative-code chapter — the agency PDF is the authoritative artifact, so it must be cited by section and effective date. A separate and narrower duty applies to cribs: documentation of each crib’s compliance with 16 CFR 1220 must be maintained. That is a records duty, not a recall check. Vermont has a third chapter for afterschool programmes that we have not reviewed.
